The COVID-19 has taken its toll on Hong Kong’s workforce. The seasonally adjusted unemployment rate jumped to 3.7% during December 2019 to February 2020, when compared to the previous three-month period ended January 2020 (3.4%). The labour market is expected to come under even greater pressure in the near term.

While SMEs struggle to stay afloat, retain talents and cut costs as much as possible, how should HR managers devise their retrenchment strategies in order not to fall into legal traps? How do employees know if their labour rights and entitlements are exploited?

  • How should pay cuts be administered legally?
  • On what grounds can an employer lay off an employee?
  • What are the employee entitlements for lay-off? Under what circumstances is an employee entitled to severance pay?
  • Can the company ask employees to take no-pay leave or annual leave?
